Refund & Cancellation Policy

This Refund & Cancellation Policy ("Policy") applies to all orders placed through the FeastFleet platform (website and mobile application) operated by FeastFleet Technologies Pvt. Ltd. (CIN: U72900KA2024PTC183456), having its registered office in Bangalore, Karnataka, India ("Company", "we", "us", or "our").

1. Eligibility for Refunds

You may be eligible for a full or partial refund under the following circumstances:

• Wrong Items Delivered: If you receive items that are materially different from what was ordered, you are entitled to a full refund for the incorrect items or a re-delivery of the correct items at no additional charge.
• Missing Items: If one or more items from your order are missing upon delivery, you are entitled to a refund for the value of the missing items.
• Quality Issues: If the food delivered is spoiled, stale, contaminated, or otherwise unfit for consumption, you are entitled to a full refund for the affected items. Photographic evidence may be requested to process such claims.
• Late Delivery: If your order arrives more than 30 minutes past the estimated delivery time displayed at the time of order placement, you may be eligible for a partial refund or delivery fee waiver, subject to review. Orders delayed due to force majeure events (natural disasters, strikes, extreme weather) are excluded.
• Order Not Delivered: If your order is marked as delivered but was not actually received, we will investigate and, upon confirmation, issue a full refund including delivery charges.

2. Refund Timeline

• FeastFleet Wallet Credit: Refunds to your FeastFleet wallet are processed within 24 hours of approval.
• Credit/Debit Card: Refunds to the original card are initiated within 24 hours and may take 5-7 business days to reflect in your statement, depending on your bank.
• UPI / Net Banking: Refunds are typically processed within 3-5 business days.
• Cash on Delivery: For COD orders, refunds will be credited to your FeastFleet wallet unless you specifically request a bank transfer, which may take 7-10 business days.

3. Non-Refundable Items

The following are not eligible for refunds:

• Orders that have been fully or substantially consumed.
• Promotional or complimentary items provided at no cost.
• Orders where incorrect delivery address was provided by the customer.
• Subjective taste preferences (e.g., "too spicy", "not sweet enough") unless the order materially deviates from the menu description.
• Claims raised more than 24 hours after delivery.

4. How to Request a Refund

You may initiate a refund request through any of the following channels:

1. In-App: Navigate to Orders → Select the order → Report an Issue → Choose the relevant category. This is the fastest method and most claims are resolved within 2 hours.
2. Email: Send a detailed description of the issue, including your order ID, to support@feastfleet.com. Please attach relevant photographs if applicable.
3. Phone: Call our customer support line at +91 80 4567 8901 (available 8 AM - 10 PM IST, 7 days a week).

5. Partial Refunds

Where only a portion of your order is affected (e.g., one missing item out of five), we will issue a partial refund proportional to the value of the affected items. Delivery charges will be refunded only if the entire order is affected or undelivered.

6. Cancellation Policy

• Before Restaurant Confirmation: Orders cancelled before the restaurant confirms and begins preparation will receive a full refund to the original payment method within the timelines specified in Section 2.
• After Restaurant Confirmation: Once the restaurant has confirmed and begun preparing your order, cancellation will result in a partial refund. A cancellation fee of up to ₹99 or 25% of the order value (whichever is lower) may be deducted to compensate the restaurant for food already prepared.
• After Pickup by Delivery Partner: Orders cannot be cancelled once picked up by the delivery partner. In exceptional circumstances, please contact support for assistance.

7. Refund to Original Payment Method

All refunds will be processed to the original payment method used at the time of placing the order, unless:

• You explicitly request a FeastFleet wallet credit (processed faster).
• The original payment method is no longer available or valid, in which case a wallet credit will be issued.
• The order was placed using multiple payment methods, in which case the refund will be apportioned accordingly.

8. Dispute Resolution

If you are unsatisfied with the resolution of your refund request, you may escalate the matter by writing to our Grievance Officer at grievance@feastfleet.com. We will acknowledge your complaint within 48 hours and endeavour to resolve it within 15 business days. For unresolved disputes, the matter shall be subject to arbitration in Bangalore, Karnataka, India in accordance with the Arbitration and Conciliation Act, 1996.

These Terms of Service ("Terms") govern your access to and use of the FeastFleet platform, including the website (www.feastfleet.com), mobile applications, and all related services (collectively, the "Platform") operated by FeastFleet Technologies Pvt. Ltd. (CIN: U72900KA2024PTC183456) ("Company", "we", "us", or "our"). By accessing or using the Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using our Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, Refund Policy, and Cookie Policy. If you do not agree to these Terms, you must not use the Platform.

2. Eligibility

You must be at least 18 years of age to create an account and use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding contracts. If you are accessing the Platform on behalf of an organization, you represent that you have the authority to bind such organization to these Terms.

3. Account Registration

• You must provide accurate, complete, and current information during registration and keep your account information updated.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account at security@feastfleet.com.
• We reserve the right to suspend or terminate accounts that contain false or misleading information, or that violate these Terms.
• One person may maintain only one active account. Duplicate accounts may be terminated without notice.

4. User Responsibilities

As a user of the Platform, you agree to:

• Provide accurate delivery addresses and contact information for each order.
• Be available to receive your order at the specified delivery location.
• Treat delivery partners with respect and dignity.
• Not engage in fraudulent activities, including but not limited to false refund claims.
• Comply with all applicable local, state, and national laws and regulations.

5. Ordering Process

• All orders placed through the Platform constitute an offer to purchase the selected items from the respective restaurant partner.
• An order is confirmed only when the restaurant partner accepts it and you receive an order confirmation notification.
• We reserve the right to refuse or cancel any order at our discretion, including but not limited to cases of suspected fraud, pricing errors, or unavailability of items.
• Menu items, prices, and availability are determined by restaurant partners and may change without prior notice.

6. Pricing & Payment Terms

• All prices displayed on the Platform are in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise.
• Delivery fees, platform fees, surge charges, and other applicable charges will be clearly displayed before you confirm your order.
• We accept payments via credit/debit cards, UPI, net banking, digital wallets, and cash on delivery (where available).
• All electronic payments are processed through PCI DSS compliant payment gateways. We do not store your complete card details.
• Promotional codes and discounts are subject to their specific terms and conditions, may have usage limits, and can be withdrawn at any time.

7. Delivery Terms

• Estimated delivery times are approximate and may vary based on restaurant preparation time, distance, traffic, weather, and order volume.
• We are not liable for delays caused by factors beyond our reasonable control, including but not limited to extreme weather, natural disasters, civil unrest, or government-imposed restrictions.
• You must ensure that the delivery address is accessible and that someone is available to receive the order.
• If a delivery cannot be completed due to customer unavailability after reasonable attempts, the order may be cancelled and charges may apply.

8. Service Availability

The Platform is currently available in select cities across India. Service availability, including restaurant selection and delivery coverage, may vary by location. We may expand, modify, or restrict service areas at our discretion without prior notice.

9. User Conduct & Prohibited Activities

You agree not to:

• Use the Platform for any unlawful or unauthorized purpose.
• Submit false or misleading refund or complaint claims.
• Harass, abuse, or threaten delivery partners, restaurant staff, or other users.
• Attempt to gain unauthorized access to the Platform, other accounts, or our systems.
• Use automated scripts, bots, or scrapers to access the Platform.
• Interfere with or disrupt the Platform's functionality or servers.
• Resell food items ordered through the Platform for commercial purposes.
• Manipulate promotions, referral programs, or loyalty rewards through fraudulent means.

10. Intellectual Property

All content on the Platform, including but not limited to the FeastFleet name, logo, trademarks, text, graphics, images, software, and user interface design, is the property of FeastFleet Technologies Pvt. Ltd. or its licensors and is protected under applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any Platform content without our prior written consent.

11. Limitation of Liability

• FeastFleet acts as an intermediary marketplace connecting customers with independent restaurant partners. We are not responsible for the quality, safety, or legality of food prepared by restaurant partners.
• To the maximum extent permitted by law, our total liability for any claim arising from the use of the Platform shall not exceed the total amount paid by you for the specific order giving rise to the claim.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
• We do not guarantee uninterrupted, error-free, or secure access to the Platform.

12. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the use of the Platform shall be resolved through binding arbitration in Bangalore, Karnataka, India, in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator mutually agreed upon by the parties, and the proceedings shall be in English. The arbitrator's decision shall be final and binding.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Subject to the arbitration clause above, the courts of Bangalore, Karnataka, India shall have exclusive jurisdiction over any disputes arising from these Terms.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified to users via email or in-app notification at least 15 days prior to the effective date. Your continued use of the Platform after such changes constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

• Browsing and search history on the Platform.
• Order history, including items ordered, restaurants visited, order frequency, and spending patterns.
• Interaction data such as clicks, scrolls, page views, and session duration.
• Referral source and marketing campaign engagement data.

c) Device Information:

• Device type, model, operating system, and version.
• Unique device identifiers (IMEI, advertising ID).
• Browser type, version, and language settings.
• IP address and network information.

d) Location Information:

• Precise geolocation data (GPS) when you grant location permissions, used to show nearby restaurants and track deliveries.
• Approximate location derived from IP address.
• Saved delivery addresses.

2. How We Use Your Information

We use your information for the following purposes:

• To process and fulfill your food orders, including assigning delivery partners and providing real-time tracking.
• To create and manage your account, authenticate your identity, and provide customer support.
• To process payments and detect or prevent fraud.
• To personalise your experience, including restaurant recommendations, search results, and promotional offers based on your preferences and order history.
• To communicate order updates, promotional offers, and service-related announcements via push notifications, SMS, email, or in-app messages.
• To conduct analytics and research to improve our Platform, services, and user experience.
• To comply with legal obligations and enforce our Terms of Service.
• To ensure the safety and security of our Platform and users.

3. Information Sharing

We may share your information with the following categories of recipients:

• Restaurant Partners: Your name, delivery address, phone number, and order details are shared with the restaurant preparing your food to fulfill your order.
• Delivery Partners: Your name, delivery address, and phone number are shared with the assigned delivery partner for order fulfillment. Phone numbers may be masked for privacy.
• Payment Processors: Payment details are shared with our PCI DSS compliant payment gateways (Razorpay, Paytm, etc.) to process transactions securely.
• Analytics Providers: Anonymized and aggregated data may be shared with analytics services (such as Google Analytics, Mixpanel) to improve our Platform.
• Legal & Regulatory: We may disclose information when required by law, court order, or government authority, or to protect our rights, safety, or property.
• Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of the transaction, subject to applicable privacy protections.

We do not sell your personal information to third parties for their marketing purposes.

We implement industry-standard security measures to protect your information:

• 256-bit SSL/TLS encryption for all data transmitted between your device and our servers.
• AES-256 encryption for sensitive data stored at rest.
• PCI DSS Level 1 compliant payment processing.

• Right to Withdraw Consent: Where processing is based on consent, you may withdraw consent at any time. Withdrawal does not affect the lawfulness of processing prior to withdrawal.
• Right to Grievance Redressal: You may raise complaints regarding data processing practices with our Data Protection Officer.
• Right to Nominate: You may nominate another individual to exercise your data rights in the event of your death or incapacity, in accordance with the DPDP Act.

7. Data Retention

• Active Accounts: We retain your personal data for as long as your account remains active and as needed to provide our services.
• Inactive Accounts: Data for inactive accounts (no activity for 24 months) is anonymized or deleted, subject to legal retention requirements.
• Transaction Records: Order and payment records are retained for 8 years in compliance with Indian tax and financial regulations.
• Support Communications: Customer support records are retained for 3 years from the date of resolution.

8. Children's Privacy

The Platform is not intended for use by individuals under the age of 18. We do not knowingly collect personal data from children. If we become aware that we have collected personal data from a child without verifiable parental consent, we will take steps to delete such data promptly. 9. International Data Transfers

Your information is primarily stored and processed in India. In certain cases, your data may be transferred to and processed in other countries where our service providers or infrastructure partners operate. In compliance with the Digital Personal Data Protection Act, 2023:

• We process personal data only for lawful purposes with valid consent or as permitted under the Act.
• We provide clear and accessible notice about our data processing activities before or at the time of data collection.

FeastFleet was founded in 2022 in Bengaluru, Karnataka, by a group of passionate food enthusiasts and technologists who believed that every Indian deserves access to their favourite meals, regardless of where they live. What started as a small team of 12 people serving a handful of neighbourhoods in Bengaluru has grown into India's fastest-expanding food delivery ecosystem.

In our early days, we focused on getting the fundamentals right — building a reliable delivery network, forging strong relationships with local restaurants, and developing a technology platform that prioritises speed, accuracy, and customer satisfaction. FeastFleet currently operates in 500+ cities across India. Our top service cities include:

2. Delivery Timeframes

Note: Delivery times are estimates and may vary based on restaurant preparation time, traffic conditions, weather, and order volume during peak hours.

3. Delivery Charges

4. Delivery Partners

All FeastFleet delivery executives ("Delivery Partners") are:

• Trained in food safety and handling protocols as per FSSAI guidelines
• Background-verified through government ID and address verification
• Equipped with insulated, tamper-proof delivery bags to maintain food temperature
• Covered under a comprehensive insurance policy while on duty
• Tracked in real-time via GPS for transparency and safety

5. Order Tracking

FeastFleet provides real-time GPS tracking for every order. Once your order is placed, you can track:

• Order confirmation and restaurant acceptance status
• Live preparation progress from the restaurant
• Delivery partner assignment and live location on the map
• Estimated time of arrival (ETA) updated in real-time
• Delivery completion confirmation with photo proof (optional)

6. Contactless Delivery

FeastFleet offers a contactless delivery option for customers who prefer minimal contact. When selecting this option:

• The delivery partner will place the order at your door, gate, or designated safe spot
• You will receive a notification with a photo of the delivered order
• No physical interaction or signature is required

7. Delivery Attempt Policy

• Our delivery partner will make 2 attempts to deliver your order
• A 10-minute waiting time is allowed at the delivery location per attempt
• The delivery partner will call and/or message you upon arrival
• If you are unreachable after 2 attempts (10 minutes each), the order will be marked as "undelivered"
• Undelivered orders due to customer unavailability are not eligible for refund

8. Failed Delivery

• Restaurant Issue (wrong item, missing item, quality issue): Full refund or re-delivery at no additional cost
• Logistics Issue (spilled, damaged during transit): Re-delivery of the order or full refund
• Customer Issue (wrong address, unavailable): No refund; FeastFleet wallet credit may be issued as a goodwill gesture

9. Weather & Force Majeure

During extreme weather conditions (heavy rainfall, cyclones, flooding), natural disasters, civil unrest, or government-imposed restrictions:

• Delivery times may be significantly extended
• Express delivery may be temporarily unavailable
• Certain areas may be marked as unserviceable temporarily
• We will notify affected customers via app notifications and SMS
• Full refund will be issued if we are unable to fulfil your order due to force majeure

10. Delivery Packaging

• All orders are packed in tamper-proof packaging with sealed stickers
• Hot food is transported in temperature-controlled insulated bags
• Cold beverages and desserts are packed separately to prevent spoilage
• We encourage restaurants to use eco-friendly, biodegradable packaging materials

11. Restricted Delivery Areas & Times

• Certain restricted zones (military areas, high-security zones, gated communities without access) may not be serviceable
• Late-night delivery (after 11 PM) may be available only in select cities and areas
• During festival periods and public holidays, service hours and availability may vary

13. Alcohol Delivery Policy

In cities and states where alcohol delivery is legally permitted:

• Valid government-issued photo ID verification is mandatory at the time of delivery
• The recipient must be 21 years of age or older (or as per applicable state law)
• Delivery will be refused if the recipient appears intoxicated or cannot produce valid ID
• Alcohol delivery is subject to state-specific excise laws and regulations
• Orders containing alcohol cannot use the contactless delivery option

How to File a Grievance

You may file a grievance through any of the following methods:

1. In-App: Open FeastFleet → Profile → Help & Support → File a Grievance. Fill in the details and submit. You will receive a Grievance Reference Number (GRN) immediately.
2. Email: Send a detailed email to grievance@feastfleet.com with your name, registered mobile number, order ID (if applicable), and a clear description of the issue.

Cancellation Policy

This Cancellation Policy applies to all orders placed through the FeastFleet platform (website and mobile application) operated by FeastFleet Technologies Pvt. Ltd. (CIN: U72900KA2024PTC183456). Please read this policy carefully before placing your order.

1. Cancellation by Customer

a) Before Restaurant Confirms

If you cancel your order before the restaurant accepts and confirms the order:

• Refund: Full refund to the original payment method
• Cancellation Fee: None
• Refund Timeline: FeastFleet Wallet (instant), UPI (3–5 days), Card/Net Banking (5–7 days)

b) After Restaurant Confirms but Before Preparation Starts

If you cancel after the restaurant has confirmed but before food preparation has begun:

• Cancellation Fee: ₹49 (flat fee deducted from refund)
• Refund: Order value minus ₹49 cancellation fee
• The cancellation fee compensates the restaurant for reservation of ingredients and kitchen time

c) During Preparation

If you cancel while the restaurant is actively preparing your food:

• Cancellation Fee: Up to 100% of the order value
• The exact fee is determined based on the stage of preparation
• Partial refunds may be available for items not yet prepared
• This policy ensures restaurants are fairly compensated for food already prepared

d) After Dispatch (Order Picked Up by Delivery Partner)

• Cancellation is NOT allowed once the order has been picked up by the delivery partner
• If you face any issues with a dispatched order (wrong items, quality concerns), please contact our customer support for assistance
• Refunds for post-dispatch issues are governed by our Refund Policy

2. How to Cancel an Order

You can cancel an eligible order through the following steps:

1. Open the FeastFleet app or website
2. Go to My Orders (or tap the active order banner)
3. Select the order you wish to cancel
4. Tap "Cancel Order"
5. Select a cancellation reason from the dropdown
6. Confirm cancellation
7. Refund (if applicable) will be initiated automatically

3. Auto-Cancellation Scenarios

FeastFleet may automatically cancel your order in the following situations:

4. Restaurant-Initiated Cancellation

If the restaurant cancels your order (due to stock unavailability, kitchen closure, or any other reason):

• Refund: Full refund to the original payment method — always, no exceptions
• Compensation: ₹50 FeastFleet wallet credit as an apology for the inconvenience
• You will be notified immediately via app notification and SMS

5. FeastFleet Pro Subscription Cancellation

• FeastFleet Pro subscription can be cancelled at any time from Profile → Manage Subscription
• Cancellation takes effect at the end of the current billing cycle
• No pro-rated refunds for partial months
• You will retain Pro benefits until the end of the paid period
• Pro benefits include free delivery, exclusive deals, and priority support

6. Frequent Cancellation Policy

To maintain service quality for all users and restaurant partners:

• Users who cancel more than 5 orders within a 7-day period may face temporary restrictions on ordering
• Repeated cancellations after restaurant confirmation may result in a warning, followed by a temporary account suspension (24–72 hours)
• This policy does not apply to cancellations made before restaurant confirmation or auto-cancellations
• Restrictions can be appealed by contacting support@feastfleet.com

7. Force Majeure Cancellations

Orders may be cancelled without charges in the event of:

• Natural disasters (floods, earthquakes, cyclones)
• Government-imposed lockdowns, curfews, or restrictions
• Severe weather conditions making delivery unsafe
• Civil unrest or law-and-order situations
• Pandemic-related operational disruptions

Full refund will be processed for all force majeure cancellations.
